Terms of Use

Acceptance

By installing or using CycleKit ("the app"), you agree to these Terms of Use. If you do not agree, do not install or use the app.

License

CycleKit grants you a personal, non-transferable, revocable license to install and use the app on devices you own or control, for your personal, non-commercial use, subject to these Terms and the Apple Media Services Terms and Conditions.

Subscriptions (CycleKit Premium)

CycleKit offers an optional auto-renewing subscription ("Premium") in two plans:

• Monthly — $5.99 per month

• Annual — $49.99 per year

Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews for the same period at the same price unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

You can manage your subscription and turn off auto-renewal by going to your App Store account settings after purchase. No cancellation of the current subscription is allowed during an active subscription period.

Any unused portion of a free trial period (if offered) will be forfeited when you purchase a subscription, where applicable.

Prices may vary by region and are subject to change with notice in the app.

Refunds

All purchases are processed by Apple. Refund requests must be made through Apple at https://reportaproblem.apple.com. We have no ability to process refunds directly.

Educational use only — not medical advice

CycleKit is provided for informational and educational purposes only. It is not a medical device. It is not a contraceptive. It is not a fertility diagnostic. Predictions are statistical estimates and may be inaccurate. Do not rely on the app for any medical, contraceptive, conception, or family-planning decision. Always consult a qualified healthcare provider.

Your content

Everything you log in CycleKit is stored on your device. We do not receive, store, or process it. You are responsible for backing up your own data using the JSON export.

No warranty

CycleKit is provided "AS IS" and "AS AVAILABLE," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. To the maximum extent permitted by law, we disclaim all such warranties.

Limitation of liability

To the maximum extent permitted by law, in no event will CycleKit, its developer, or its licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill arising out of or related to your use of (or inability to use) the app, even if advised of the possibility of such damages. Our total liability for any claim arising out of or related to the app will not exceed the amount you paid us in the twelve months preceding the claim, or $50, whichever is greater.

Termination

You may stop using the app and delete your data at any time. We may suspend or terminate availability of the app or any feature, including Premium, with reasonable notice in the app or App Store listing. Sections that by their nature should survive termination (License limits, Disclaimers, Limitation of Liability, Governing Law) will survive.

Apple-specific terms

You acknowledge that these Terms are between you and the developer, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. Apple is a third-party beneficiary of these Terms and may enforce them against you.

Governing law

These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws principles. Any dispute will be brought exclusively in state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts.

Changes

We may update these Terms when we ship new versions of the app. Continued use after an update constitutes acceptance of the updated Terms.
